By placing an order on offduty.in, you confirm that you have read, understood, and agreed to this Shipping Policy in its entirety. This Policy forms part of the legally binding terms of your purchase contract with Off Duty India under Section 10A of the Information Technology Act, 2000.

1. Order Processing

All orders placed on offduty.in will be processed and dispatched within 2 working days from the date of order confirmation, subject to payment verification and product availability.

Working days are Monday to Friday, excluding public holidays. Orders placed on weekends or public holidays will be processed on the next working day.

Note on Order Confirmation

An order is considered confirmed only upon successful payment verification. For Cash on Delivery (COD) orders, the order is confirmed at the time of placement. Off Duty India reserves the right to cancel any order prior to dispatch in case of pricing errors, stock unavailability, or failed payment verification, with full refund of any amount paid.


2. Delivery Timeframes

Once dispatched, orders are typically delivered within the following indicative timeframes:

The above timeframes are indicative estimates only and do not constitute a guarantee of delivery by a specific date. Actual delivery may vary depending on the delivery location, pin code serviceability, and factors beyond Off Duty India's reasonable control. See Section 5 (Force Majeure) for full details.


3. Tracking Information

  • A tracking link will be sent to your registered email address and mobile number via SMS once your order is dispatched.
  • The tracking link will provide real-time updates on your order's status, including dispatch, in-transit, and out-for-delivery notifications.
  • If you do not receive a tracking notification within 3 working days of your order confirmation, please contact us at help@offduty.in.
  • Tracking information is provided by our third-party logistics partners and Off Duty India is not responsible for inaccuracies in tracking data caused by the courier system.

4. Shipping Partners

Off Duty India partners with reputable third-party courier companies to deliver your orders, including but not limited to Bluedart, Delhivery, and Ecomexpress. The selection of the courier partner for a specific order is at Off Duty India's discretion based on serviceability, delivery zone, and operational requirements.

Off Duty India operates as a seller on its own platform and does not own or operate proprietary last-mile delivery infrastructure. Delivery is handled exclusively by independent third-party logistics providers.

Liability of Shipping Partners

Once a shipment is handed over to the courier partner and a tracking ID is generated, the physical custody and transit responsibility for the package transfers to the courier. Off Duty India's obligation is to dispatch the correct product in adequate packaging. Any damage, loss, or delay occurring during transit after handover to the courier is the responsibility of the logistics provider. Off Duty India will, however, assist customers in escalating such issues with the courier partner as a gesture of goodwill.


5. Force Majeure — Events Beyond Our Control

Off Duty India shall not be held liable for any delay or failure in delivery caused by events beyond its reasonable control, including but not limited to the following ("Force Majeure Events"):

(a) Extreme weather conditions including floods, cyclones, heavy rainfall, or natural disasters;
(b) Government-declared holidays, curfews, bandhs, political rallies, or election-related restrictions;
(c) Government embargos, restrictions on movement, or state or central government directives;
(d) Landslides, road blockages, or natural obstructions affecting transit routes;
(e) Strikes, lockouts, or industrial action affecting courier operations;
(f) Any other event beyond Off Duty India's reasonable control that could not have been anticipated or prevented.

In accordance with Section 56 of the Indian Contract Act, 1872, performance of delivery obligations shall be treated as suspended for the duration of a Force Majeure Event. Off Duty India will make reasonable efforts to communicate any such delays and resume normal operations as soon as practicable.

Force Majeure Events do not entitle a customer to an automatic refund for a delayed shipment that is still in transit. Refund eligibility in such circumstances is governed by Section 8 of this Policy.


6. OTP Verification & Delivery Conduct

Off Duty India uses an OTP-based delivery verification system for all shipments. The OTP is generated by the logistics system and sent exclusively to the mobile number registered against your order. Please read the following binding terms carefully:

OTP Rules — Binding Terms
1 Do NOT share the OTP until you have physically received and inspected your parcel. The OTP is your authorisation of delivery. Providing the OTP to the delivery executive constitutes your confirmation that the parcel has been received by you in an acceptable condition.
2 OTP sharing = Transfer of delivery liability. Once you share the OTP with the delivery executive, delivery is legally confirmed and risk in the goods transfers to you as the buyer, in accordance with Section 33 of the Sale of Goods Act, 1930. Off Duty India's liability as the seller is discharged upon OTP-verified delivery. Any claim of non-receipt after voluntary OTP disclosure will not be entertained.
3 Do NOT share the OTP if you are rescheduling delivery. If you request the delivery executive to reschedule or return at another time, do not provide the OTP under any circumstances. Providing the OTP during a rescheduling request will result in the shipment being marked as delivered and returned, and Off Duty India will not be liable for the resulting loss.
4 Do NOT share the OTP with anyone other than the delivery executive at the time of physical receipt. Off Duty India customer support will never ask for your delivery OTP. Never share your OTP over phone, WhatsApp, email, or any digital channel.

⚠ Legal Position on Premature OTP Disclosure

If a customer voluntarily provides the OTP to the delivery executive before physically receiving the parcel, Off Duty India's delivery obligation is legally discharged. Any subsequent claim of non-delivery will be treated as a dispute between the customer and the logistics provider. Off Duty India will assist in escalating such cases with the courier as a goodwill measure only, and is not obligated to issue a refund or replacement in such circumstances.


7. Delivery Issues & Disputes

7.1 False Delivery Status / Marked Delivered But Not Received

In certain instances, last-mile delivery executives may incorrectly mark a shipment as delivered before actual delivery. This is a known issue across the e-commerce industry and is the responsibility of the courier company.

If you receive a delivery confirmation notification but have not received your parcel, you must:

  1. Immediately check with neighbours, building security, reception, or anyone at your premises who may have accepted the delivery on your behalf.
  2. Contact the courier company's customer care directly to raise a non-delivery complaint and obtain a complaint reference number.
  3. Notify Off Duty India within 24 hours of the delivery notification via WhatsApp at 7208971846 or email at help@offduty.in.
  4. Provide your Order ID, tracking ID, and any evidence (photographs, CCTV if available, building management confirmation).

⚠ Strict 24-Hour Reporting Window

Non-delivery claims must be reported within 24 hours of the delivery notification. Claims reported after this window will not be entertained, as investigation with the courier company becomes significantly more difficult and evidence of delivery status may no longer be preserved. This window is consistent with our Return & Exchange Policy.

Once reported within the applicable window, Off Duty India will escalate the matter to the courier company. Resolution typically takes 3–5 working days. Off Duty India will keep you informed of the escalation status.

7.2 Damaged Parcel at Delivery

If your parcel appears damaged, tampered with, or has broken seals at the time of delivery:

  • Do NOT accept the parcel if the damage is severe. Request the delivery executive to mark it as "Rejected — Damaged" and obtain a rejection acknowledgement.
  • If you accept the parcel, record an unboxing video immediately before opening.
  • Report the damage to Off Duty India with photographic/video evidence on the same day of delivery via help@offduty.in.
  • Claims of damage reported after the same day of delivery will not be entertained.

7.3 Incorrect or Incomplete Delivery

If you receive a wrong product or an incomplete order, report the issue within 24 hours of delivery with photographic evidence to help@offduty.in. Off Duty India will investigate and arrange a resolution in accordance with our Return & Exchange Policy.


8. Cancellation in Transit & Refund for Delayed Delivery

8.1 Cancellation After Dispatch

Once an order has been dispatched, it cannot be cancelled directly by the customer. If you wish to cancel a dispatched order, Off Duty India will contact the courier company to initiate a return-to-origin (RTO) request. The following conditions apply:

  • RTO requests are subject to the courier company's operational capability and cannot be guaranteed.
  • A refund will be initiated only after the courier company confirms the shipment is being returned to our warehouse AND the returned product is physically received and inspected by Off Duty India.
  • Refunds for cancelled dispatched orders will be processed within 7–10 working days of receipt of the returned product at our warehouse.
  • For COD orders, the COD charge of ₹100 is non-refundable even in case of cancellation.

8.2 Refund for Significantly Delayed Delivery

If your order has not been delivered within 15 working days from the date of dispatch (excluding Force Majeure Events as defined in Section 5), you may request a cancellation and refund by contacting help@offduty.in.

Upon receipt of your refund request, Off Duty India will:

  1. Investigate the shipment status with the courier company within 3 working days.
  2. If the shipment is confirmed lost by the courier, initiate a refund within 7 working days of such confirmation.
  3. If the shipment is still in transit, provide you with a revised estimated delivery date.

Refund Processing Note

All refunds are subject to Off Duty India receiving confirmation from the logistics partner regarding the shipment status. Off Duty India cannot process refunds for shipments that are confirmed to be in active transit by the courier. Refunds will be credited to the original payment source. For COD orders, refund will be processed via bank transfer or UPI through our payment partner.


9. Pin Code Serviceability

Delivery is subject to serviceability at your delivery pin code by our logistics partners. Off Duty India currently ships across India to all serviceable pin codes.

In the event that your pin code is not serviceable at the time of dispatch, Off Duty India will notify you promptly and offer one of the following resolutions:

  • Delivery to an alternate serviceable address provided by you;
  • Full refund of the order amount if no alternate address is available.

Off Duty India does not currently offer international shipping.


10. Misuse, False Claims & Legal Consequences

⚠ Legal Warning

Off Duty India maintains comprehensive digital records of all orders, dispatch confirmations, tracking logs, OTP verification records, and delivery documentation. Any false claim made against Off Duty India in connection with a shipment will be met with the full force of applicable Indian law.

The following conduct constitutes misuse of Off Duty India's shipping and delivery process and may result in legal action under applicable Indian law:

(a) Making a false claim of non-delivery after voluntarily providing the delivery OTP, with intent to obtain a refund or replacement — actionable under Section 318, Bharatiya Nyaya Sanhita, 2023 (cheating);
(b) Filing a false or exaggerated consumer complaint regarding delivery, with knowledge that the claim is false — actionable under consumer protection law and may expose the complainant to costs;
(c) Initiating an unauthorized chargeback or payment reversal for a shipment that was delivered with OTP verification — actionable under applicable banking and consumer fraud law;
(d) Making false, defamatory, or misleading public statements about Off Duty India's shipping or delivery practices — actionable under Section 356, Bharatiya Nyaya Sanhita, 2023 (defamation).

11. Governing Law & Jurisdiction

This Shipping Policy and all disputes, claims, or proceedings arising from the shipping and delivery of orders placed on offduty.in shall be governed by the laws of India.

Subject to the mandatory jurisdiction provisions of the Consumer Protection Act, 2019, any disputes shall be subject to the jurisdiction of the competent courts and consumer forums located in Mumbai, Maharashtra, India.

Before initiating any legal proceedings, customers are requested to first contact our Grievance Officer at legal@offduty.in and allow 30 working days for resolution, in accordance with our Grievance Escalation Policy.
